A one-man battle, with some help from his friends. . .
KELLY GOES AT IT AGAIN WITH DITTO.COM

Photographer/author, Les Kelly, who in February won a personal copyright misuse case involving one of his photos (see PhotoStockNOTES, March 2002, page 1), continues to engage Ditto.com (formerly Arriba Soft, Inc. and now known as Sorceron).
Ditto.com has appealed to the Ninth Circuit Court of Appeals for an "en banc" hearing to the decision in Kelly's favor released on February 6, 2002. Kelly's position is that the February court decision establishes that copyright law does apply to intellectual property on the Internet.
"It establishes important case law for use of thumbnails, for linking, inline linking and framing. The decision in clear language is supported by case law. Ossola, Sigall, Krongold and Amici Curiae fully dispel the flawed notions raised by Ditto.com that the Court's ruling erred in its decision that Arriba Soft's Image Searcher display of full-sized images was copyright infringement," says Kelly.

"My attorneys also successfully disputed the flawed notions raised by Internet giant Google.com and the Electronic Frontier Foundation that the Ninth's decision jeopardized all linking. Easy Writer
Just as you always carry a camera or two as a photographer, as a writer you always carry writing tools. They can be as simple as a pen and pad, as expensive as a high-end laptop. Our tool of choice lies halfway between. We travel with an AlphaSmart - one for each of us.
The Alphasmart is a portable word processor. It runs on three double-A batteries and costs a little over two hundred bucks. It weights 2 pounds. It's the answer to a travel writer's dream.
Though designed for school kids, the AlphaSmart does almost everything a road-writer needs. It holds 64 pages of copy. It downloads to just about any computer on earth. It's indestructible - even by sadistic baggage handlers. It's small enough so you can type on a plane - even when squashed into economy-class seats. And, best of all, it goes for 300 hours on those three little batteries.
Since we often travel with two computers as well as Effin's cameras, we save about twelve pounds by carrying AlphaSmarts instead of full-size laptops.
The AlphaSmart comes with one more bonus feature. Because it's a road machine, not a main frame, if it's stolen, all you've lost is 200 bucks and 64 pages of words.

ANTIQUE ALREADY? Still cameras and camcorders might soon go the way of LP's. As an editorial stock photographer, what could be more ideal than to carry a device that produces both still and video pictures, plus audio? No longer would we be relegated to the slow lane of STILL-ONLY. By capturing all three platforms, we would make ourselves an important resource also to the world of radio and TV\cinema.
At the Photo Marketing Association's trade show last winter, Sigma Corp unveiled the SD9, a single-lens-reflex digital camera that incorporates a new-technology photosensor from Foveon. The company boasts that its X3 technology produces image-quality exceeding that of film, with images captured by the larger of its two sensors supporting enlargement to 30 inches on a side. X3 technology holds out the possibility of delivering, from a single camera, image quality equal to, or exceeding, that obtainable now from both a still and a video camera. For photographers who routinely carry two digital still-camera bodies, X3 could mean adding video without having to lug around a third, larger device. -RE

Start Small = Big Results
You might approach an editor with the most enticing idea for a feature story but, unless you have very strong credentials, many editors will be wary of commissioning you if they don't already know you and have maybe worked with you a couple of times.
Even if a writer has a long list of impressive-looking clips, the editor still can't be sure commissioned articles will be delivered on time, in the required format, and with all necessary sidebar information, or that the writer works in a professional manner and is pleasant to deal with.
If you are in the position of having to propose stories to editors who don't know you, one option is to attach your manuscript to your query. By doing this, you clearly overcome any doubts the editor might have about whether or not you can deliver the article on time. However, this would only work if the editor is happy to consider manuscripts which haven't been specifically requested.
In other instances, when you can't submit a manuscript before an editor has confirmed interest in your query, approach editors you don't know with queries for shorter pieces, initially. All travel writers want to produce the cover feature for their favorite publication, and this is totally understandable. However, until you are well-known to the editor, you will stand a much greater chance of having queries accepted if you query departments that carry shorter, and therefore lower risk, pieces.
