TRAINING PHOTOBUYERS

Should you "hand-hold" your photobuyers through the process of accessing your website? Yes, says Jagdish Agarwal of the Dinodia Picture Agency in India.
The ever-changing advances in computer operations and software have made some photobuyers wary of learning to use the Web as a source for their photo needs. To overcome this dilemma, a stock agency in India, Dinodia, has come up with a free unique customer service: They enlighten photobuyers on the benefits of the Internet.
Jagdish Agarwal, owner of Dinodia, invites photobuyers to a one-hour free consultation at his agency. Clients not only learn of the newest software but, 1.) how to access sites and locate subject matter; 2.) which are the sites that offer them maximum variety; 3) how to judge quality of pictures; 4.) how to access specific pictures at lower cost and buy them on-line through one's international credit card.
Agarwal says, "All this is so easy, photobuyers wonder why they never made maximum use of the Internet in the past."
THE RESULTS
Jagdish Agarawal reports that the response to his invitation has been positive.
"But there's a bit of psychology involved here," says Agarwal. "Some photobuyers are intimidated by the Internet, others know more than I do, so I have to be careful not to sound like a teacher, but like a friend who is there to help."

Why Low-Paying Markets?
A photographer recently asked on our chat section, the Kracker Barrel >http:/www.photosource.com/board<, why our marketletter, The Photoletter, listed low-paying book and magazine markets. Here was our response.
PhotoStockNotes (May 2002) featured our annual list of photography-oriented sites available on the Web, posted in order of ranking as compiled by Alexa.com. There were 152 companies listed.
In that April issue we also separated out the 26 websites that appeal directly to stock photographers, listed in ranking order as per Alexa. PhotoSource International is listed Number One, with the highest ranking. Our site gets 15,000 hits per day.
Within our site, we are always curious to know which section receives the most traffic. Of our 57 sections, the most popular, other than the Home Page, is Stock Photography 101.*
SP 101 is designed for photographers just breaking into the stock photo industry. Its popularity reflects that there are many photographers out there who are new to the field, and who are hungry for how-to information.
IN THE ARTS, RARELY DO YOU START HIGH
Few photographers just starting out or starting over in stock are going to break in at the top. They work their way up. They choose magazines to work with initially that are on the low end of the payscale, markets that the pros don't work with. A newcomer will accept the lower pay from these outlets, for the promotional benefit of the chance to showcase their work and get tearsheets of their published photos. A published picture acts as strong evidence of credibility for a photographer making new potential photobuyer contacts.
Why Two Market Letters?
This is the reason we have two marketletter services here at PSI. The PhotoDaily, for the pros, lists only photo needs that pay above $100 per image. Lower-paying markets are listed in a second, weekly marketletter called the PhotoLetter. These markets don't have a substantial budget for photography, yet they don't wish to resort to rock-bottom Royalty Free images. Average pay range in the PhotoLetter is $25-$50 per image.
PhotoLetter features such publications as American Fitness Magazine, and other special interest, regional, or non-profit publications, or those which have an audience so small that their budget won't allow professional rates. For photographers new to the field, these markets are equivalent to the farm teams in major league baseball, or to summer stock opportunities for actors just breaking into the field of acting. And we all know that many a Hollywood star got his or her start in low-budget movies.

Shackleton 'Endurance' Pictures Make Online Debut on Alamy Images. Rare Shackleton selections are available for purchase on the Internet for the first time, as of April 30, 2002. Alamy Images (Abingdon, UK), a leading online provider of specialist images and general material from the world's major picture agencies and photographers, is offering 40 images from the Shackleton collection. They are available on alamy.com, and consist of scenes of the crew engrossed in day-to-day tasks, the barren landscape, and the ship trapped and listing in ice, during the 1914 - 1916 Antarctic expedition. Digital Reality
There's no doubt that digital technology in the stock photography industry is advancing constantly. But how far has it advanced, where is it going to, and when will it get there? Having recently finished a survey of editorial stock photography buyers, I've come closer to understanding where we are when it comes to digital submissions.
Most photobuyers welcome digital previews with open arms. But many are still reluctant to accept digital images for the final submission. Most editorial photobuyers have been disappointed with digital submissions from stock photographers in the past. They say they are not getting the digital quality they want and the way they want it.
How You Submit
With digital images - be they from a digital camera or a scan - the accuracy in how you submit to a photobuyer is crucial. A slide is a slide is a slide, but a digital image can be saved in the wrong format, the wrong size, the wrong resolution and so on. If one of these is wrong, that might be enough to make the image unusable for the photobuyer, and the photobuyer is forced to scramble to select a different picture for publication.

Transfer of Exclusive License by Licensee Requires Consent
When you, as the owner of copyrighted photographs, grant an exclusive license for the use of these photographs to a licensee, there is an expectation that the licensee will be the only entity that uses the photographs for the intended purpose. There is also an expectation that the licensee will not transfer these rights to someone else without your consent.
The United States Court of Appeals of the Ninth Circuit has confirmed that, in fact, this is the law, and that any such transfer without the consent of the copyright owner may constitute copyright infringement.
The facts in the case, Gardner v. Nike, Inc., are relatively simple. Nike entered into a written license agreement with Sony Music Entertainment Group, which granted to Sony the right to exploit a cartoon character called MC Teach, on and in the packaging of phonograph records and other merchandise, and exploitation of MC Teach in connection therewith, in exchange for a percentage of the profits earned. Nike retained ownership of the copyrights. The agreement was silent as to Sony's right to assign its rights under the exclusive license.
Thereafter, Sony in fact assigned its rights in this exclusive license to Gardner in exchange for a share of the proceeds derived from use of the MC Teach character. After Nike threatened legal action because of this unauthorized assignment, Gardner commenced litigation seeking a judgment declaring the transfer to be valid. (Sony, which interestingly made no representations to Gardner about its rights, took no position other than to agree to abide by any Court decision.)
