Sampling -- It Won't Go Away . . .
The Internet is becoming a free-for-all for music entrepreneurs who creatively "borrow" originals and mix them into their own "originals." Will you find parts of your pictures in a montage of someone else's some day?
Music lovers call it "mash-up" or "bootleg" and it's found on the Internet. It could be a harbinger of what's in store for stock photographers.
"Mash-ups" are "songs" that combine different hit songs without adding any original music. They may represent the first significant new musical genre to be lifted out of the underground, developed, and then spread, mostly via the Web. (Remember "sampling" in the 90's -- Oribital's "Halcyon & On & On"?) The songs typically match the rhythm, melody and underlying spirit of the instrumentals of one song, with the a cappella vocals of another. And the more odd the pairing the better.
MOZART WAS THERE
Classical music lovers know that "sampling" is not new. Mozart, Bach, and Handel all acknowledged existing tunes of the day by using fragments of music from their contemporaries. It wasn't considered infringing, but fits more closely to what might be interpreted today in the Copyright Law as an "authorship" issue.
Technological forces today have encouraged this kind of "borrowing." Cheap computer software, for example, makes it possible for a teenager with no musical knowledge to create professional-sounding productions at home using Internet peer-to-peer services, such as Napster, KaZaa, Audiogalaxy, Spinfrenzy.com and Jungkemonkey.com, which provide a quick way to gather and share music.
Naturally, the music industry is concerned about this, because in most cases the sound tracks are being used without permission. Does file sharing pose a threat to income? Some studies have shown that it does not. Curiously, if sampling were entirely illegal, groups such as Puff Daddy, Missy Elliot, Steps, and other top 40 groups would not have been able to come forth and make money for the major record label companies that now decry sampling. In the world of art, postmodernist Andy Warhol would have found his hands tied in legal battles, thanks to his Campbell Soup depiction and certain other paintings.
AND SO WAS SHAKESPEARE
How does this apply to your stock photos on the web? Should you remove them immediately to prevent someone from using part of your picture as a sample, and then hiding under the protection of the Copyright Law ("authorship")? That is up to you. But sampling is not going to go away. In fact, since Shakespeare's time, and even earlier, "borrowing" from other artists to expand or 'improve' a work of art has been commonplace.

"It Doesn't Work anymore!"
On a recent British Guild of Travel Writers trip to Manchester, England to see the brand new facilities for the 2002 Commonwealth Games in July, the biggest international sporting event in the UK since the 1948 Olympic Games, one of my colleagues proudly showed me her digital camera, a Nikon 995. She has been very pleased with the results and ease of use and asked when I was going digital.
We got to the magnificent new stadium, which is nearing completion, and I left the writers listening to the PR person and got busy finding interesting angles to shoot. Suddenly my colleague appeared holding up her Nikon with a disconcerted look on her face, "It doesn't work anymore, what can I do?" she said.
The camera was dead, so I first told her to switch it on and off a few times, it could be a dirty switch, but this was to no avail. My next suggestion was to change the battery, so she did this after I cleaned the contacts, which were dirty, but it still wouldn't come alive. So my last resort was something that often works with electronic equipment when all else fails, I told her to give it a good thump. She looked aghast then tapped the camera gently, so I took hold of it and gave the reluctant machine a solid whack. It sprang to life and she was able to take pictures again.

Estimated Taxes
Q. I started providing stock photos for a local non-profit organization. I billed the organization by the hour and earned $2500 total. They paid me directly by check. Regarding taxes on this, how do I pay it? Can I wait and pay all my income and self-employment taxes at once, each year, through a Schedule C and Schedule SE? Or do I need to make estimated quarterly payments?
A. Yes, you are liable for paying taxes yourself and may have to make quarterly estimated payments, instead of waiting until April 15th. Once you figure out your expenses for your work, and subtract the expenses from the income, the profit shown on Schedule C counts as reportable income. One of the advantages of being self-employed is that you can deduct many expenses incurred for business reasons. This would include depreciation on your computer, home office expense, photo supplies, any direct expenses (stationery, printing, envelopes, travel, automobile, etc.) related to your stock photography business. You also fill out Schedule SE for the Self-Employment taxes on the next profit. To make quarterly payments, fill out a form 1040-Est which you can download from > www.irs.gov < . In addition to the income tax, the self-employment tax (which is FICA tax) is 15.30% of your net profit. But you get a deduction for half the self-employment taxes on page 1 of Form 1040.

"Fammin'" -Getting Invited Part 2
The best way to get invited on a FAMiliarization Tour is to publish your photos and stories so frequently that your name automatically comes up when P.R. people are deciding who gets an invitation to Ireland or Japan or on that culinary tour of the Laurentians.
But you needn't mope and champ at the bit until that happy day rolls around. Let's say you've published half a dozen photos that could, without too much of a stretch, be construed as travel pictures. And let's say you've published three or four articles in local papers on a particular place, a restaurant, an interesting event or fair or industry, a historical area, etc. etc.
And let's say you want to go to New Orleans. Not for Mardi Gras, when everyone else in the world goes there, but for, say, the Tennessee Williams Literary Festival.
Call the New Orleans Convention & Visitors Bureau. Ask them for info on the town and the festival. Have them send you a press kit. Once you've studied it, query some newspapers and regional magazines for assignments on the event. Then, assignments in hand, call the CVB back, tell 'em what you've got, and ask, "Are you running any fam tours around that time?"
If they say, "Why, yes, and we'd love to have you join us," start packing. If they say, "No, but we'd like to bring you down on your own," start packing.
If they just say "No," keep publishing your stuff. Next time they'll say, "Yes, yes, oh God, yes!"
