PROTECTING YOUR IMAGES

Q: I have a theory on how to prevent the stealing of photos from my webpage. I have purposely put un-sharp pictures on my page. This will prevent any unauthorized use of them.
A: I wouldn't worry about theft. Tales of theft are often exaggerated hearsay -- theft by markets that matter is almost nonexistent. You do yourself, your work, and your promotion efforts a grave disservice by not putting your best subjects and best quality out there for potential customers to see.
Pete Turner put his best up... so why not you also?
Q: To ensure the quality image I put on my webpage will not be taken -- should I watermark?
A: No -- not at all. I think you'll see less and less of this watermark thing. It only says to a potential customer: "I don't trust you." So what if a college kid or small newsletter steals a photo -- is it that much of a loss to you -- especially when you think of potential buyers that could be seeing your excellent photography? You're pretty safe. Professionals have little to gain and a lot to lose (their reputation and integrity) by "borrowing" your image.
Q: Should I caption my web photos?
A: Yes, put extensive captions on your photos. Put yourself in the place of a photobuyer: If they are looking for a birch bark canoe, they don't look for "boat" or "canoe" -- they look for "birch bark canoe." If your photos are properly captioned -- they'll find you, and pass over other photographers who don't realize how important it is to give time to captioning their photos with thoroughness.

Generating Great Ideas For Articles
Part 1
As a writer/photographer, many of your articles can write themselves if you gather unique information that is available free.
Photographers'/Writers' Guidelines
Obtain and study photographers’/writers' guidelines provided by publications that interest you. Read the publication itself, ideally several copies! Writers' guidelines don't just tell you how long articles should be and what format to use when making submissions. They often also provide vital clues as to what subjects are likely to be of interest to the publication. Using a search engine, you can find the guidelines of most publications by typing in the name of the publication and the word "submissions."
Think Like Your Reader
Put yourself in the place of your reader and try to imagine what destinations and activities would appeal most. If you were thinking up article ideas to propose to a lifestyles magazine catering for fairly well-to-do over-50s, stories involving backpacking travel and basic hostels are probably not going to be the most relevant. Many over-50s are highly fit and active but they more often appreciate their travel comforts and will require a certain degree of luxury on trips. Four and five star hotels would generally be more appropriate than hostel accommodation for them.
Your Next Trip
Consider every trip or travel experience you make as a potential subject of your articles for publication. Even if you're on a private holiday rather than a press trip, be prepared to collect the facts you need to enable you to write up the trip in due course should you wish to. You never know when you might want to write up a travel experience.
Record how you got to your destination, details of where you stayed and your impressions of the hotels. What were their good points? What were they not so good at? Was there anything uniquely good or uniquely bad about them? Distinctive features and real life experiences will provide you with the detail you need to transform your writing from mere collections of facts into vibrant articles people will find both informative and fascinating to read.
Be disciplined. You might only be going away for a day or maybe a long weekend, but the facts you can collect about your destination in that time could easily be more than enough for several articles.

WHY SHOULD I REGISTER A PHOTO ?

Q: I'm confused about what my 'copyright rights' are when it comes to whether I'm protected by the blanket copyright in a magazine that publishes my picture. Also, if I haven't paid the registration fee for a photo, I always thought I could still register it within 90 days to get copyright protection and damages. Has this all changed?

A: Here's a non-complex answer to your question(s). Yes, your photo is "copyrighted" once you click the shutter. But if a major corporation lifts your photo and uses it for their own purposes, their lawyers will tell you to 'buzz off' if you haven't already registered your picture with the Copyright Office. The reality of it is that although you own the copyright to your photo, you cannot sue until you have registered your picture. That may take awhile, when you add on the time to make the suit, find a lawyer, contact the infringing company (the time alone is racking up a lot of your personal time) - with no guarantee that you will win the suit.
The simple answer is to register those pictures you feel are vulnerable to infringement (you have 90 days within publication of the picture). It's possible to receive up to $150,000 statutory damages if someone uses your picture illegally. If you put legal action into play, an attorney will most probably take your case on a contingency basis (i.e. he/she doesn't get paid unless you win the case- which you probably can, if you register your picture(s)).
As far as the blanket copyright in a book or magazine, recent cases suggest that you have little or no protection from the publisher's blanket copyright (see PhotoStockNOTES, #373, October, 2001 page 4) And unless you have personally registered the picture, you won't be able to sue for statutory damages.

Jim Pickerell of Selling Stock is conducting a "Stock Photographer Income Survey" on his website at www.pickphoto.com/sso (click on the 2003 Survey button), to determine the income trends of stock photographers. There are four simple questions to answer. The data the survey will generate, if there is broad participation, will be invaluable to everyone in the stock photo industry. The survey is open to all stock photographers. The results will be made available in the public sections of Jim's site and also will be published in PhotoStockNotes. Pickerell says, "The responses are anonymous. No one will be able to connect income numbers to a particular individual." The deadline for responding is January 30th, 2003.
