Turning On The Digital Switch

Cameras do it. Researchers do it. Photographers do it. And now, PhotoStockNotes is doing it.

We're going digital.

This will be the last "paper" edition of PhotoStockNOTES. Starting in October, your newsletter will be delivered to you electronically -- and not monthly, but weekly.

 

October 1st marks ten years to the day that we launched the monthly PhotoStockNOTES, as an 8-page, mail-delivered newsletter. We will now combine psNOTES and your PhotoAIM.

The new format will offer you more pages, more speed, and information in convenient weekly segments -- keeping up with the digital age we live in. You'll receive new benefits through the digital delivery system: time-sensitive information sooner; coverage of up-to-the-minute photography trends and innovations; features on new markets; additional market interviews and insights; downloadable and storable articles and reports.

 

FREQUENCY AND PRICE

 

You will receive PhotoAIM conveniently in weekly sections, a different section every week, four times each month (sometimes five). Subscription cost is $5 per month or $36 per year. (You save $24 when you pay by the year). Your PhotoAIM subscription will continue at the old rates up until January 1st 2004.

 

HOW TO ACCESS IT

 

Using your computer, you'll be able to click on PhotoStockNOTES every Thursday. The official starting date is October 2nd. We will send you a reminder announcement of the change, along with instructions on how to access your issues.

You can choose one of three methods for delivery of your issues of weekly PhotoStockNOTES:

PDF File; HTML attachment; C2C; or Plain Text.

All four methods will allow you to download any of the material for convenient storage on your hard drive for later reference or use.

If your e-mail program is older than 1998, you'll probably want to elect to receive PhotoStockNOTES as a "text" file, or switch to a newer e-mail program.

Kelly v. Arriba Round III

As you may undoubtedly recall, Leslie Kelly previously sued Ditto.com (which was formerly known as Arriba soft corp), for infringing his copyrights. The United States Court of Appeals for the Ninth Circuit has now partially reversed its own opinion and sent part of the case back to the District Court for a trial on the issues.

As I reported in the April 2000 issue of PhotoStockNotes, Pg.5, the original District Court decision held that the use of thumbnail sketches of Kelly's images in the search engine was a fair use.  I reported subsequently in the April 2002 issue, Pg.5, that the Circuit Court affirmed as to the thumbnail fair use, but reversed as to the use of the full screen image display, holding that such use constituted copyright infringement.

The facts are as follows. Ditto.com operates an Internet search engine that displays its results in the form of small thumbnail-size images rather than the more usual form of text. It obtains its image database by copying images from other websites, including Kelly's. A larger version of the thumbnail image appears when a viewer clicks on the thumbnail. However, the larger image actually transports a full-size high-resolution image onto the screen directly from Kelly's website.

Upon rehearing, the Circuit Court adhered to its original determination that the thumbnail size use of the images was a fair use. It also withdrew its determination that the display of a full size image constituted copyright infringement on the technical ground that neither party had requested summary judgment on the issue of copyright infringement as to the larger image. Accordingly, the Circuit Court sent the issue back to the District Court for further proceedings.

WHO ARE YOU COMPETING AGAINST?  If your file contains calendar-type generic pictures, you are competing against two levels: 1.) The giants:  CORBIS and GETTY IMAGES; 2.) The former major stock agencies (that still exist) from the 1990's. In contrast, if you are a specialist in one or a few specific subject areas, (gardening, pediatrics, geology, NASA, France, fly fishing, etc.), you probably have only a handful of competitors. If your photo collection shows that you are a generalist, change your ways. Pick one or a couple of subject matters that you love photographing, and become a mini-expert in those fields. When you specialize, the Internet allows you to compete easily with the Big Boys, because for them it is not cost-effective to specialize. But it can work for you. -RE
